Habito’s Monthly Mortgage Payment Prize Draw Terms & Conditions

Hey Habito Ltd’s (“we”,”us”,”our”,”Habito”) monthly mortgage payment prize draw (the “Prize Draw”) is a series of monthly free Prize Draws whereby we randomly select a Habito Prize Draw entrant and pay off that entrant’s monthly mortgage payment.

These terms & conditions (“T&Cs”) apply to the Prize Draw which is run through Habito website, newsletter and/or social media accounts or through any other forum which promotes the Prize Draw from time to time.

1. The Prize Draw and how to enter

1.1

The Prize Draw is a series of free monthly prize draws, which you may enter if you are eligible.

1.2

You only have to enter the Prize Draw once to be eligible for each monthly Prize Draw.

1.3

There is a limit of one entry per eligible person.

1.4

You can enter the Prize Draw on the Habito website.

1.5

By entering the Prize Draw, you agree to these T&Cs and are responsible for making sure the details in your Habito account are correct.

1.6

Entering the Prize Draw won’t affect the terms of your mortgage.

1.7

The prize for each monthly draw is the payment of the winner’s exact monthly mortgage amount up to a cap of £2,500 into the winner’s nominated bank account.

2. Eligibility

2.1

You will be eligible to enter the Prize Draw if you:

2.1.1

have a Habito account or sign up for a Habito account;

2.1.2

are resident in the UK and the property on which your mortgage is secured is in the UK; and

2.1.3

have entered the Prize Draw and agreed to these T&Cs.

2.2

You won’t be eligible for the Prize Draw if you:

2.2.1

are an employee or contractor of Habito or if any other person named on your mortgage is an employee or consultant of Habito;

2.2.2

are an employee or contractor of agents or suppliers of Habito who are professionally connected with the Prize Draw or its administration;

2.2.3

are found to have arrears on your mortgage account. For the purposes of these T&Cs, arrears means when a total sum of £1 or more of the monthly payment(s) due remains unpaid at the time of the draw;

2.2.4

are found or have been found guilty of fraud; or

2.2.5

have entered the Prize Draw yourself through more than one Habito account.

2.3

If you become an employee of Habito after you have entered the Prize Draw, you won’t be eligible for any of the following monthly Prize Draws but you can enter again if you later stop being employed at Habito

2.4

In entering the Prize Draw, you confirm that you are eligible to do so and eligible to claim the prize you may win. We may require you to provide proof that you are eligible to enter the Prize Draw.

2.5

We reserve all rights to disqualify you from the Prize Draw if your conduct is contrary to the spirit or intention of the Prize Draw.

2.6

We’re not responsible if we inadvertently pay a prize to an entrant who doesn’t qualify, but we’ll take reasonable steps to make sure this doesn't happen.

2.6.1

Where we discover such an error has happened, the entrant inadvertently paid must repay the prize to us and we reserve the right to demand repayment of the prize from the entrant inadvertently paid.

2.6.2

Once we have received the prize money from the entrant inadvertently paid, we will subsequently pay the prize to the next eligible entrant we randomly select.

3. Things to note

3.1

If you enter the Prize Draw by creating a new Habito account and previously secured your mortgage through another broker, we have the right to ask you to provide supporting evidence of your monthly mortgage amount, such as a recent bank statement or a mortgage statement.

3.2

You can only win once - so if you’ve entered the Prize Draw and won one month you can’t win again.

3.3

You might hold your mortgage jointly with another person - in this case only one of you can enter the Prize Draw to take part.

3.4

If you enter the Prize Draw but subsequently close your Habito account, we won’t include you in the Prize Draw.

4. Your mortgage

4.1

The mortgage you hold must be held in your name or by you and your joint mortgage holder.

4.2

If you have a buy-to-let mortgage, your mortgage must not be held in a company name.

4.3

We won’t include you in the Prize Draw if you redeem your mortgage before a Prize Draw takes place or close your Habito account.

4.4

If you are selected as a winner in a Prize Draw, your monthly mortgage amount will be paid directly into a bank account nominated by you and held in your name.

4.5

If you are selected as a winner in a Prize Draw and this triggers an early repayment charge or other charge on your mortgage, then you will be responsible for paying your early repayment charge. Please contact your lender for further details on how your repayment charge is calculated.

4.6

If you hold more than one mortgage, we will only make one monthly mortgage payment: for the mortgage which has the highest monthly mortgage payment, subject in all cases to the cap of £2,500.

5. This Prize Draw

5.1

The Prize Draw is free to enter.

5.2

We will carry out the Prize Draw indefinitely on the first Tuesday of every month until we decide to end the Prize Draw in accordance with these T&Cs.

5.3

We will pick a winner randomly from the qualifying entrants for that month. Entrants who qualify to take part have an equal chance of winning.

5.4

All prizes in the Prize Draw are non-negotiable or transferable.

6. Winners

6.1

If you win the Prize Draw, we will let you know as soon as practicable after the relevant announcement date using the email address associated with your Habito account. If your email address changes, please email us at hey@habito.com with your current email address so that we can let you know if you have won.

6.2

If you win, we’ll tell you what information we may need from you before your monthly mortgage amount will be paid.

6.3

If you win, we may ask you to take part in publicity, such as publishing your surname on the Prize Draw website or taking part in an interview which we publish on our website. You don’t have to if you don’t want to.

6.4

Unless we publish the Prize Draw winner on the Habito website, any Prize Draw entrant may request your last name and country of residence as the prize winner by emailing us at hey@habito.com.

6.5

By entering the Prize Draw, you give us permission to make your last name and country of residence available in this way if you win. If you object to your surname and country of residence being published or made available, please contact Habito at hey@habito.com. In such circumstances, Habito must still provide the information in relation to the winner and the Prize Draw to the Advertising Standards Authority on request.

7. Claiming the Prize

7.1

You will have 30 days from the date we contact you to claim your prize. If we don’t hear from you and you do not claim your prize by this date, you will no longer be entitled to the prize.

7.2

We will make all reasonable efforts to contact you if you have won. If you cannot be contacted (for instance because your email address is not accurate), or you have not claimed your prize within 30 days of the announcement date, we reserve the right to offer the prize to the next eligible Prize Draw entrant selected from the entries that were received before the Prize Draw closing date.

7.3

We do not accept any responsibility if you are unable to take up the prize.

7.4

If you don’t want to take part in any future monthly Prize Draws, please let us know by emailing us at hey@habito.com.

8. The Promoter

This Prize Draw is operated and run by Hey Habito Limited, a company registered under the laws of England & Wales whose registered address is Throgmorton UK Ltd Reading, 4th Floor, Reading Bridge House, George Street, Reading, Berkshire, RG1 8LS. We are regulated by the Financial Conduct Authority under registration number 714187.

9. Other legal stuff

9.1

If we can’t carry out the Prize Draw on the scheduled date and time, and it isn’t cancelled under these T&Cs, it will take place as soon as reasonably possible afterwards.

9.2

We won’t be responsible to any eligible entrant if a Prize Draw cannot go ahead or is delayed or cancelled for any reason.

9.3

Our decision with regard to the process of administering the Prize Draw, and selection of a winner, is final and absolute.

9.4

We can cancel any of the monthly Prize Draws or stop running the Prize Draw entirely without telling you beforehand, however we will let you know by putting a notice on the Habito website.

9.5

We may use your name and the personal information which you provide to us in entering the Prize Draw for the purposes of the Prize Draw and as described in these T&Cs. We will process and store your information in accordance with our privacy policy.

9.6

If there’s a disagreement about these T&Cs, we hope you’ll let us know so that we can try and resolve the issue. These T&Cs are governed by the laws of England and Wales, and only the courts in England and Wales can resolve any legal disputes.
